1. Introduction

Welcome to Olymaris (“Olymaris”, “we”, “our”, or “us”). These Terms of Service (“Terms”) govern your access to and use of our websites, mobile applications, and related services (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use our Services.

These Terms apply to both consumers (§13 BGB) and business users (§14 BGB), unless otherwise specified.

2. Legal Compliance

We strive to comply with applicable European Union and German laws, including the General Data Protection Regulation (EU) 2016/679 (GDPR), the Directive 2011/83/EU on Consumer Rights, the German Civil Code (BGB), and the Telecommunications-Telemedia Data Protection Act (TTDSG).

3. Eligibility

You may use our Services only if you are at least 16 years old (or the legal age in your country) and have the legal capacity to enter into binding agreements under applicable law.

4. Scope of Services

Olymaris develops and provides AI-powered mobile and web applications, including but not limited to:

• Olymam — AI assistant for mothers and expectant parents
• Olycar — AI tool for drivers and fleet management
• Olytravel — AI travel assistant
• Other upcoming services (e.g., Olydate, Olygram)

We reserve the right to modify, suspend, or discontinue any Service at any time without prior notice.

5. License and Use Restrictions

Olymaris grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Services in accordance with these Terms. You agree not to:

• Copy, modify, or redistribute the Services or any part thereof;
• Reverse engineer, decompile, or disassemble the Services;
• Use the Services for unlawful, deceptive, or harmful purposes;
• Infringe upon intellectual property or proprietary rights of Olymaris or others;
• Use bots, scrapers, or automated systems without permission.

All rights not expressly granted are reserved by Olymaris. Violation of these restrictions may result in immediate suspension or legal action.

6. User Accounts

To access certain Services, you may need to create an account. You must provide accurate and truthful information when creating an account and keep your credentials confidential. You are responsible for all activity under your account.

You have the right to request account deletion at any time under Art. 17 GDPR.

7. Data Protection & Privacy

Your personal data is processed in accordance with our Privacy Policy and the GDPR. You have the right to access, rectify, or erase your data, restrict processing, and file a complaint with your local Data Protection Authority.

8. Intellectual Property

All trademarks, software, and design elements are owned by Olymaris or its licensors. All intellectual property is protected under German and EU copyright law (UrhG, Directive 2001/29/EC). No part of the Services may be reproduced or reused without our written consent.

9. Paid Services and Subscriptions

Some Services may include paid features. Prices and terms are displayed before purchase. EU consumers have a 14-day withdrawal right under EU law.

You can exercise your withdrawal right by emailing support@olymaris.com within 14 days of purchase. If you request that the service begin immediately, you expressly agree that your right of withdrawal expires once the service has been fully provided.

10. Disclaimer

The Services are provided “as is” and “as available.” Olymaris makes no warranties, express or implied, regarding fitness, reliability, or availability. This does not affect mandatory consumer rights under EU or German law.

11. Limitation of Liability

To the fullest extent permitted by law, Olymaris is not liable for indirect or consequential damages, including lost data or profits. This limitation does not apply to liability for death, injury, fraud, or breach of essential contractual obligations (Kardinalpflichten). For free Services, Olymaris shall only be liable for intent and gross negligence.

12. Consumer Rights (EU Residents)

EU consumers retain their statutory rights under EU law, including fair terms, pre-contract information, and a 14-day withdrawal period as described above.

13. Suspension and Termination

Olymaris may suspend or terminate access without notice for legal or contractual violations. Rights granted end immediately upon termination.

Upon termination, your personal data will be deleted or anonymized in accordance with our Privacy Policy and applicable retention obligations under the GDPR.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany and the European Union. Jurisdiction lies in Chemnitz, Germany, unless mandatory consumer law provides otherwise. The United Nations Convention on Contracts for the International Sale of Goods (CISG) shall not apply.

15. Changes to These Terms

We may update these Terms to reflect legal or operational changes. Updated versions will show a new “Last Updated” date. We will notify users of material changes via our website or email before the new Terms take effect. Continued use of the Services after such updates constitutes acceptance of the revised Terms.
